Last week, in the 3rd District Courtroom, in Athens, Joshua Lee Seale was convicted on Driving While Intoxicated, Third or More, and ultimately sentenced to 15 years in the Texas Department of Criminal Justice.
THE CASE
On February 3, 2025, Gun Barrel Police Officer Greg Ceraso conducted a routine traffic stop after Seale ran a red light on West Main Street just after 10:00 PM.
Upon arrival at the stopped vehicle, Officer Ceraso smelled a strong odor of burnt marijuana coming from the vehicle and quickly observed that Seale had bloodshot, watery eyes and slurred speech.
Seale admitted to the on-scene officer that he had consumed 5 beers, however, Officer Ceraso had observed a whiskey bottle, a box of Twisted Tea, and a vodka bottle inside the vehicle.
Ceraso took Seale into custody and upon arrival at the Henderson County Justice Center, he was charged with DWI. During the pre-arrest search, it was determined that Seale was in possession of marijuana in his front pocket.
THE TRIAL
Henderson County Assistant District Attorney Jeff Herrington prosecuted the state, with Judge Mark Calhoon, presiding.
According to a press release issued by DA Jenny Palmer, Seale’s punishment was enhanced to a felony because of his criminal history, which included two prior DWI convictions.
His record also includes a prison sentence for Unlawful Possession of a Firearm by a Felon and Assault on a Public Servant, along with multiple convictions for theft, Possession of a Controlled Substance and other offenses.
“Driving While intoxicated puts everyone on the road at risk, and repeat offenses make that danger even more concerning,” DA Palmer stated. “When someone continues to drive impaired despite previous convictions, there must be serious consequences. This sentence protects the public and sends a clear message that repeated drunk driving will not be treated lightly.”
